Field operator alleges oilfield services company failed to pay overtime

HOUSTON — A Fort Bend County man is suing an oilfield services company, alleging failure to pay overtime wages. 

Cedric Fuller filed a class action complaint, individually and on behalf of all others similarly situated employees, Oct. 13 in the Houston Division of the Southern District of Texas against ESG USA Inc. alleging violation of the Fair Labor Standards Act.

According to the complaint, Fuller worked for ESG as a field operator in several states, including Texas, California, and Pennsylvania. The suit says Fuller was paid an hourly rate of pay without receiving overtime premium for all hours worked in excess of 40 in a week. 

The plaintiff alleges ESG USA misclassified him as exempt from overtime and failed to compensate Fuller's overtime hours at the rate of one and one-half times his regular rate of pay as required by FLSA.

Fuller seeks trial by jury, unpaid overtime compensation, liquidated damages with penalty and interest, attorney fees, costs, expenses and all other relief. He is represented by attorneys Don J.
