HOUSTON – Tenants of a Magnolia home allege the property owners failed to warn them of toxic black mold in the home.
David Sullivan and Laurel Fauster, individually and as next friend of Harlei Sullivan, filed a complaint on Oct. 14 in the Harris County District Court against Garden Oaks 1 LLP, Allied Orion Properties LLC and William Carroll alleging negligence and other counts.
According to the complaint, the plaintiffs allege that on Sept. 13, they confirmed that their home was contaminated with toxic mold, which caused them to suffer allergic reactions that led to substantial medical expenses. The suit states the property was leased by the plaintiffs from the defendants.
The plaintiffs holds Garden Oaks 1 LLP, Allied Orion Properties LLC and Carroll responsible because the defendants allegedly failed to make reasonable inspection of the subject property, failed to evaluate and/or remediate the problem and failed to warn them of the dangerous condition of the property.
The plaintiffs request a trial by jury and seek monetary relief of more than $200,000 but not more than $1 million, attorney's fees, costs of court and any other relief as the court may deem appropriate. They are represented by Robert Morse of Daspit Law Firm in Houston.
