Cement worker alleges former employers failed to pay overtime

HOUSTON — A cement finisher is suing a Houston company, alleging violation of workers compensation acts in failing to pay overtime.

Jose Maria Gomez Ramos filed a class action complaint, individually and on behalf of all other similarly situated employees, Oct. 19 in the Houston Division of the Southern District of Texas against Houston Gunite Inc. and Jaime Pena, alleging they violated the Fair Labor Standards Act.

According to the complaint, during Ramos' tenure with Houston Gunite from 2012 to July 29, 2016, he regularly worked 50 hours or more per week without receiving any overtime premium for hours worked more than 40 per week. 

The plaintiff alleges the defendants failed to properly compensate him for all work performed as required by FLSA.

Ramos seeks trial by jury, judgment equal to his unpaid overtime wages at the applicable rate, liquidated damages, prejudgment interest, attorney fees and court costs and all further relief the court deems equitable. He is represented by attorneys Josef F. Buenker and Vijay A. Pattisapu of The Buenker Law Firm in Houston.
