League City man alleges partner failed to make good on payments

GALVESTON — A League City man is suing a Houston business, alleging breach of fiduciary duty.

John Kosty filed a lawsuit Oct. 19 in Galveston County District Court against Integrated MRI & Diagnostic LLC and Integrated MRI LP, alleging failure to comply with their partnership agreement.

According to the complaint, Kosty suffered monetary damages for not receiving monthly distributions from the operation of his partnership with the defendants. The suit says the last distribution was made in January for $2,500 instead of the usual $5,000 or $7,000.

The plaintiff alleges the defendants failed to pay the distribution, failed to maintain the finances and accounts of their partnership and denied Kosty's request to examine the books and records of the partnership.

Kosty seeks trial by jury, monetary relief between $200,000 and $1 million, pre- and post-judgment interest, court costs, attorney fees and all other relief to which he is entitled. He is represented by attorneys Darrell A. Apffel, D. Blake Apffel and Lauren F. Arisco of Apffel Legal PLLC in League City.
