GALVESTON — A New Jersey man is suing a Texas City health care provider, alleging its negligence led to the death of a relative.
Barry Clayton Lancaster of Hunterdon County, New Jersey, as an heir of Barry Lancaster, filed a lawsuit Oct. 24 in Galveston County District Court against Bay Oaks SNF LLC, doing business as The Lakes at Texas City, also doing business as Bay Oaks Health Care Center, alleging the defendant deviated from the standard of care.
According to the complaint, Barry Lancaster, 77, was a long-term resident at the Bay Oaks nursing home. During his confinement, the suit says, his intact skin rapidly deteriorated into a Stage 4 pressure ulcer. Upon admission to a hospital, the lawsuit states, he was found to be in acute respiratory distress and had bilateral pneumonia and was severely malnourished and dehydrated, leading to his death Oct. 3, 2015.
The plaintiff alleges the defendant's staffs and/or employees failed to perform complete and accurate assessments, failed to implement necessary interventions and allowed Barry Lancaster's conditions to rapidly deteriorate.
Barry Clayton Lancaster seeks trial by jury, monetary damages between $200,000 and $1 million, compensation for all damages, pre- and and post-judgment interest, costs of court and all other relief. He is represented by attorney Robert Wharton of Brown Wharton & Brothers in Houston.
