HOUSTON — A Harris County man is suing Houston supermarket operators, alleging violation of workers compensation acts in failing to pay overtime.
Yasel Campos filed a class action lawsuit, individually and on behalf of all others similarly situated, Oct. 21 in the Houston Division of the Southern District of Texas against Prudent Inc., doing business as Super Mercado El Paisano and Mahendi Prasla, alleging violation of the Fair Labor Standards Act.
According to the complaint, during Campos' tenure with the defendants as a butcher that started in August 2015, he regularly worked more than 40 hours per week without receiving overtime pay at a rate not less than one and one-half times his regular rate of pay for each hour worked in excess of 40 a week as required by FLSA.
The plaintiff alleges the defendants failed to pay the statutory overtime pay, failed to maintain proper time records and retaliated against Campos by terminating his employment for engaging in protected activity.
Campos seeks trial by jury, an order allowing this case to proceed as a collective action, all unpaid overtime wages, liquidated damages, attorney fees and court costs, pre- and post-judgment interest and all other relief to which he is justly entitled.
