Disabled employee accuses Family Dollar of unlawful termination

BEAUMONT — A disabled Texas worker is suing his former employer, alleging wrongful termination.

Robert T. Stogner filed a lawsuit Oct. 26 in the Beaumont Division of the Eastern District of Texas against Family Dollar Inc., alleging failure to uphold the Family and Medical Leave Act and Americans with Disabilities Act regulations.

According to the complaint, Stogner's physical condition required him to take time off from work and he was allowed to work with restrictions. On June 28, the suit says, Stogner was unlawfully terminated from Family Dollar, where he had worked since 2009. 

The suit says Stogner has has suffered damage to his reputation, humiliation and mental anguish. The plaintiff alleges Family Dollar engaged in a hostile work environment, failed to provide reasonable accommodations and retaliated against him by terminating his employment for requesting reasonable accommodations.

Stogner seeks trial by jury, compensatory, punitive and liquidated damages, reinstatement or front pay, attorney fees and court costs, plus all other additional equitable relief. He is represented by attorney Ashok Bail of Houston.
