Vehicle passenger accuses insurance provider, adjuster of fraud

HOUSTON — A Harris County woman is suing an insurance provider and adjuster, alleging conspiracy to commit fraud.

Julia Munguia filed a lawsuit Oct. 28 in Harris County District Court against United Services Automobile Association and Jeanette Buecher, alleging the defendants breached their duty of good faith and fair dealing.

According to the complaint, on June 19, 2014, Munguia was a passenger in a vehicle that was insured by USAA. The suit says another vehicle failed to maintain its place in the right lane and collided with plaintiff's vehicle head on.

The suit says the collision caused Munguia severe and debilitating injuries. To date, she has not received any payment for her damages, the lawsuit states. 

The plaintiff alleges Buecher failed to perform a reasonable inspection of Munguia's claim and USAA wrongfully denied her claim under the terms of the policy.

Munguia seeks trial by jury, monetary relief between $500,000 and $1 million, attorney fees, court costs, pre- and post-judgment interest and all other further relief.
