Day's Inn seeks up to $1 million from insurance company

HOUSTON — Day's Inn is suing an insurance company, alleging breach of duty of good faith and of fair dealing.

Galleria Hotel Investments LLC, doing business as Days Inn, Houston, filed a lawsuit Oct. 31 in Harris County District Court against Northfield Insurance Company, alleging violation of the Texas Insurance Code.

According to the complaint, on March 25, 2015, Day's Inn property in Houston suffered storm-related damages. Despite making complete payment for its obligations in a timely fashion, the suit says, Day's Inn has not received proper payment for its claim under the commercial policy insurance. 

The plaintiff alleges Northfield Insurance improperly investigated the plaintiff's extensive losses and has refused to make any reasonable attempt to settle the plaintiff's claim.

Day's Inn seeks trial by jury, monetary relief between $200,000 and $1 million, pre-judgment interest, attorney fees, court costs and all other just and equitable relief. It is represented by attorney Scott G. Hunziker of The Voss Law Firm PC in The Woodlands.
