Huntsville woman alleges apartment building operator failed to properly light stairway

HOUSTON — A Huntsville woman is suing Kings Cove Apartments LLC, an apartment operator, citing alleged failure to warn, taking insufficient measures to prevent injuries and negligence.

Anna Maiorano filed a complaint on Oct. 31 in the Harris County District Court against Kings Cove Apartments LLC alleging that the apartment operator breached its duty to exercise reasonable care to avoid harm to others.

According to the complaint, the plaintiff alleges that, on May 30, 2015, she arrived at defendant's Kings Cove apartment in Kingwood to help her daughter move out of her apartment when she missed a step and fell down the stairs. As a result, she sustained injuries that caused her to suffer past and future pain and suffering, medical expenses, mental anguish and loss of household service. The plaintiff holds Kings Cove Apartments LLC responsible because the defendant allegedly failed to install adequate light in the area and failed to protect and/or barricade the public from this danger.

The plaintiff requests a trial by jury and seeks judgment against defendant for damages in an amount within the jurisdictional limits of the court, with pre- and post-judgment interest, costs of court and such other relief to which she may show herself justly entitled.
