Man alleges ladder provided by contractors for painting project slipped, caused fall

HOUSTON – A Harris County man employed as a subcontractor claims he was injured when a ladder he was provided with to use to paint a structure slipped.

Oscar Moreno filed a complaint on Oct. 31 in the Harris County District Court against All-Pro Stucco & Stone LLC and Tipler Custom Builders alleging negligence.

According to the complaint, the plaintiff alleges that on Jan. 26, he was working under the control of defendants and was standing on a tall ladder when suddenly the ladder slipped, causing him to fall to the ground and sustain serious injuries. The plaintiff holds All-Pro Stucco & Stone LLC and Tipler Custom Builders responsible because the defendants allegedly failed to provide a safety device or safe means of climbing a ladder and failed to warn him of the said dangerous condition.

The plaintiff seeks judgment against defendants, jointly and severally, for all damages he sustained, interest, costs of court and such other relief he may be justly entitled. He is represented by Joseph R. Corteguera of The Stern Law Group in Bellaire.
