GALVESTON — Two employees are suing Tyson Foods Inc., alleging the defendant's negligence led to injuries suffered by the plaintiffs.
Sayde Rodriguez and Maria Diaz filed a lawsuit Oct. 31 in the Galveston Division of the Southern District of Texas against Tyson Foods Inc., alleging breach of duty to exercise ordinary care that was owed the plaintiffs.
According to the complaint, on Jan. 7, 2015, Rodriguez and Diaz were working at the Tyson facility, 300 Portwall St. Houston, when a metal wall came loose and fell on them causing permanent and catastrophic injuries, which necessitated surgery for both plaintiffs. The suit says they suffered physical pain and mental anguish, necessary medical expenses and loss of earnings.
The plaintiffs allege Tyson Foods failed to keep a safe workplace, failed to provide safety devices and failed to warn the plaintiffs of the unreasonably hazardous condition.
Rodriguez and Diaz seek trial by jury, damages together with costs and disbursements, pre- and post-judgment interest, plus all relief to which they are justly entitled.
