League City homeowners accuse insurer of breaching contract

GALVESTON — Two League City homeowners are suing an insurance company, alleging deceptive trade practices.

Shelie and Mark Martin filed a lawsuit Nov. 1 in Galveston County District Court against USAA Casualty Insurance Company, alleging lack of of good faith and fair dealing in settling a claim for fire damages.

According to the complaint, on Feb. 7,  the Martins' League City home sustained significant damage caused by fire during the policy period. The suit says the plaintiffs immediately reported the damage and filed a claim with USAA Casualty. 

As a result defendant's mishandling the damage estimation, the lawsuit states, the Martins were underpaid. The plaintiffs allege USAA Casualty did not even inspect the property or assign an adjuster, underpaid the loss and failed to provide reasonable explanations.

The Martins seek trial by jury, monetary award for all damages between $200,000 and $1 million, pre and post-judgment interest, attorney fees and costs and all other relief to which they are justly entitled. They are represented by attorneys Darrell A. Apffel, Lauren F. Arisco and D. Blake Apffel of Apffel Legal PLLC in League City.
