HOUSTON — A Dallas County man is suing a New York debt collector, alleging unlawful collection practices.
Brandon Fiume filed a lawsuit Nov. 3 in the Houston Division of the Southern District of Texas against Northstar Location Services LLC of Erie County, New York, alleging violation of the Fair Debt Collection Practices Act.
According to the complaint, in July, Fiume began receiving calls to his cellular telephone from Northstar, attempting to collect an alleged debt. Despite Fiume's request to stop calling him, the defendant continued to call.
On Aug. 11, Fiume started to receive calls at work, wherein the defendant disclosed to Fiume's boss that it wanted to discuss an issue with him regarding a loan.
The plaintiff alleges Northstar Location violated the FDCPA by communicating in connection with the collection of a debt with a person other than Fiume.
Fiume seeks trial by jury, judgment for statutory damages of $1,000, attorney fees and any other appropriate relief. He is represented by attorney Michael S. Agruss of Agruss Law Firm LLC in Chicago.
