TYLER — Two employees are suing a Longview health care home service provider, alleging violation of workers compensation acts in failing to pay overtime.
Angela Ellison and Jamey Chustz filed a class action complaint on behalf of themselves and all others similarly situated Nov. 3 in the Tyler Division of the Eastern District of Texas against Pace Opportunity Centers Inc. alleging violations of the Fair Labor Standards Act and the federal Portal-to-Portal Pay Act.
According to the complaint, Ellison and Chustz regularly worked more than 40 hours per week without receiving proper overtime compensation from the defendant. The plaintiffs allege Pace Opportunity Centers failed to pay overtime at a rate not less than time and one-half their regular rates of pay for each hour worked more than 40 in a week and failed to forward their insurance premium wage deductions to the purported health care insurance company.
Ellison and Chustz seek trial by jury, an order certifying this case as a collective action, all damages, including back overtime wages and liquidated damages, legal fees, costs, pre- and post-judgment interest and all other relief to which they are entitled.
