Therapy provider alleges nursing facility failed to pay for services

HOUSTON — A Kentucky therapy services provider is suing a Houston nursing facility, alleging breach of contract, failure to pay for completed work and unjust enrichment.

Rehabcare Group East Inc., doing business as Rehabcare of Louisville, Kentucky, filed a lawsuit Nov. 4 in the Houston Division of the Southern District of Texas against Winterhaven Healthcare Residence Operator LLC, doing business as Winterhaven Healthcare Residence, alleging failure to perform its obligations under the terms of the therapy services agreement.

According to the complaint, on Oct. 1, 2015, Rehabcare entered into an agreement to provide therapy services to patients at Winterhaven but the outstanding balance remains unpaid. 

Rehabcare alleges despite repeated demands for payment, the defendant has failed and refuses to pay for services provided by the plaintiff.

Rehabcare of Louisville seeks trial by jury, judgment for all damages, court costs, expenses, attorney fees, pre- and post-judgment interest and all other relief to which it is entitled.
