HOUSTON — A Harris County woman is suing a Houston restaurant operator, alleging the defendant's negligence led to injuries for the plaintiff.
Rose Womack filed a lawsuit Nov. 4 in Harris County District Court against Pizza Properties Inc., doing business as Peter Piper Pizza, alleging failure to make the premises' condition reasonably safe.
According to the complaint, on April 12, 2015, Womack was at Peter Piper Pizza, 6127 Highway 6 North in Houston. The suit says she tripped and fell on a rubber stopper at the end of a bench leg causing her to sustain a broken right hip and injuries to her right knee.
The lawsuit says Womack's injuries caused physical pain, mental anguish, medical expenses and loss and/or reduction in earnings. The plaintiff alleges Peter Piper Pizza failed to properly maintain the rubber piece in a safe and a reasonable manner and failed to adequately warn her of the dangerous condition.
Womack seeks trial by jury, monetary relief between $200,000 and $1 million, pre- and post-judgment interest, costs of court and all other relief. She is represented by attorneys Loren G. Klitsas and Jared W. Capps of Klitsas & Vercher PC in Houston.
