Laborer alleges masonry contractors failed to pay overtime

HOUSTON — A Houston man is suing masonry contractors, alleging violation of workers compensation acts by not paying overtime.

Carmen A. Martinez filed a lawsuit Nov. 4 in the Houston Division of the Southern District of Texas against Ranch Masonry, Inc., Ranch Masonry and Cast Stone LLC, Josefina Garcilazo and Arturo Garcilazo, alleging they violated the Fair Labor Standards Act.

According to the complaint, Martinez, who began working for the defendants in 2012, routinely worked more than 40 hours per week but was not paid one and one-half times his regular hourly rate for hours worked more than 40 per week. The suit says he was terminated from his employment following a work-related injury. 

The plaintiff alleges the defendants failed to pay proper overtime compensation at the statutory rate allowed FLSA.

Martinez seeks trial by jury, unpaid overtime compensation, liquidated damages, attorney fees, court costs and expenses, pre- and post-judgment interest and all other relief. He is represented by attorneys Mark Siurek and Patricia Haylon of Warren & Siurek LLP in Houston.
