HOUSTON — A Montgomery County motorist is suing a trucking company and one of its employees, alleging their negligence led to a crash that injured the plaintiff.
Christian Cephus of Spring, Texas, filed a lawsuit Nov. 4 in the Houston Division of the Southern District of Texas against Kroger Dedicated Logistics Co. and Samuel Mack of Shreveport, Louisiana, alleging Kroger negligently hired a driver who was unfit and reckless.
According to the complaint, on Aug. 14, Cephus was traveling northbound on Interstate Highway 45 in Conroe. The suit says Mack, acting in the course and scope of his employment for Kroger, crashed into Cephus' vehicle, causing property damage and injuries to the plaintiff.
The lawsuit states Cephus has sustained past and future medical expenses, pain and suffering, mental anguish and a loss of wages and earning capacity of up to $2 million. The plaintiff alleges Mack failed to keep a proper lookout, changed lanes when it was unsafe to do so and failed to apply the brakes in a timely manner.
Cephus seeks trial by jury, actual damages, pre- and post-judgment interest, costs of suit and all other relief to which he is entitled. He is represented by attorney Brenna L. Sanchez of The Dunk Law Firm PLLC in Houston.
