HOUSTON – A family alleges their minor child was injured at a Taco Bell restaurant when a chair collapsed while in use.
Jose Cardenas and Imelda Cardenas, individually and as next friend of minors J.C. and A.C., filed a complaint on Nov. 10 in the Harris County District Court against B&G Food Enterprises of Texas LLC alleging negligence.
According to the complaint, the plaintiffs allege that on May 6, 2015, plaintiffs visited defendant's Taco Bell restaurant in Houston when suddenly and without warning the restaurant chair where their child was sitting suddenly collapsed. As a result, minor J.C. allegedly sustained serious injuries resulting in physical pain and mental anguish, medical expenses, disfigurement and discomfort. As a result, the plaintiffs allege they and A.C. suffered severe mental and emotional anguish.
The plaintiffs holds B&G Food Enterprises of Texas LLC responsible because the defendant allegedly failed to have adequate safety policies, failed warn them of the existence of the dangerous condition and failed to remedy said dangerous and/or hazardous condition.
The plaintiffs request a trial by jury and seek compensation for all damages in excess of the minimum jurisdictional limits of the court, plus interest, costs for this action and any further relief they may be entitled.
