Houston couple alleges swimming pool contractors broke contract

HOUSTON — A Houston couple is suing local swimming pool contractors, alleging breach of contract and breach of warranty.

Alan and Victoria Riffle filed a lawsuit Nov. 10 in Harris County District Court against Pinnacle Pools of Texas Inc., doing business as Platinum Pools and Platinum Pools Services Inc., alleging negligent representation and breaching their construction contract.

According to the complaint, the Riffles suffered property damages, including losing the use and/or deterioration of their back yard and driveway, pool and spa, loss of the benefits of the original bargain and out-of-pocket expenses for repairing the swimming pool and spa. 

The plaintiffs allege the defendants negligently deviated from their contractual requirements and failed to construct the swimming pool on the Riffle property at 5454 Cedar Creek, Houston, in a competent and workmanlike manner and without defects.

The Riffles seek trial by jury, monetary relief between $200,000 and $1 million, attorney fees, court costs, pre- and post-judgment interest and all other just relief. They are represented by attorney Andrew P. Tower of Houston.
