Dental business alleges competitor violated trademark law

HOUSTON — A Saginaw dental business is suing a Spring competitor, alleging trademark infringement and unfair competition in using the same name.

Brush Dentistry PLLC filed a lawsuit Nov. 16 in the Houston Division of the Southern District of Texas against Dr. Phuong Pham, doing business as Brush Dentistry, alleging violation of trademark and other related intellectual property rights.

According to the complaint, the defendant's actions in using the same Brush Dentistry name have resulted in confusion in the marketplace that will cause substantial monetary damages to the plaintiff. 

The plaintiff alleges the defendant used a business name of Brush Dentistry that is similar to the plaintiff’s name and trademark and failed to take any actions to cease using the plaintiff’s Brush Dentistry trademark.

Brush Dentistry in Saginaw seeks trial by jury, an order the for defendant to cease using the plaintiff's trademarks, logos and any other mark that is confusingly similar to plaintiff's, damages, attorney fees, court costs and fees, plus all other appropriate relief.
