Pharmaceutical company alleges chemical distributor owes $371,000

TEXARKANA — A Bowie County pharmaceutical company is suing a Seattle chemical distributor, alleging negligence and breach of warranties.

Humco Holding Group Inc. filed a lawsuit Nov. 16 in the Texarkana Division of the Eastern District of Texas against Univar USA Inc., alleging the defendant breached its duty to provide safe, unadulterated acetone.

According to the complaint, Humco suffered monetary damages of $371,453.66, additional unliquidated damages due to the negative impact on its business reputation and actual loss of business with customers. 

The plaintiff alleges Univar USA negligently contaminated the acetone with a liquid solvent and failed to tender monies for the damages caused to the plaintiff.

Humco Holding Group seeks trial by jury, actual damages amounting to at least $371,453.66, plus unliquidated damages, pre- and post-judgment interest, court costs, attorney fees and all other proper relief.
