Five laborers accuse employers of failing to pay overtime

TYLER — Five employees are suing a Longview business, alleging violation of workers compensation acts in failing to pay overtime.

Aaron Keith, Joel Farrell, Ryan Coulter, Chris Griffin and Shalon Bowen filed a lawsuit Nov. 16 in the Tyler Division of the Eastern District of Texas against Joyce Steel Erection Ltd., Joyce Crane Inc. and Joe Bob Joyce,  alleging violation of the Fair Labor Standards Act.

According to the complaint, the five plaintiffs worked in excess of 40 hours per week without receiving proper overtime compensation and were only paid overtime for work that can be passed onto their customers. The plaintiffs allege the defendants failed to pay overtime for all hours worked in excess of 40 hours per week at a rate not less than one and one-half times their regular rate of pay as required by FLSA and failed to maintain accurate pay records.

The plaintiffs seek trial by jury, unpaid overtime wages, liquidated damages, attorney fees, court costs and expenses, pre- and post-judgment interest and all other just and proper relief. They are represented by attorney Josh Borsellino of Fort Worth.
