Athletic facility owners accuse former account signatory of assault

HOUSTON  — Owners of a Houston athletic facility are suing a former account signatory, alleging assault, intentional infliction of emotional distress and trespassing.

O Athletik LLC, George Rives, Joanie Rives, Spencer Rives and Alejandra Rives filed a lawsuit Nov. 17 in Harris County District Court against James O. Cooper, alleging violation of the Texas Penal Code.

According to the complaint, the plaintiffs suffered damages in the form of apprehension of being anywhere within Cooper's presence and fear of loosing their lives and causing injuries to bystanders. The plaintiffs allege Cooper refused to provide information regarding his expenditures, threatened to cause bodily injury and death to the plaintiffs and entered the plaintiffs' facility at 767 N. Shepherd Drive, Houston, without permission.

The plaintiffs seek trial by jury, monetary relief between $200,000 and $1 million, a temporary restraining order, a permanent injunction and all other proper relief. They are represented by attorneys Kent M. Hanszen and Matthew S. C. Hansel of Hanszen Laporte LLP in Houston.
