Patient blames doctors for wrong diagnosis

BEAUMONT — A Cherokee County patient is suing Jefferson County health care providers, alleging their negligence led to health problems for the plaintiff. 

Dana Smith filed a lawsuit Dec. 6 in Jefferson County District Court against Dr. Garrett Peel, Keli McCalman, Dr. Mithani Waheeda, Dr. Joseph Nightingale, Previty Surgical, PLLC and Dr. Ramon Garcia, alleging they did not properly evaluate the plaintiff's condition.

According to the complaint, in 2014, Smith suffered serious and disabling injuries, particularly the resection of a large segment of her gastrointestinal tract, because the defendants failed to diagnose and treat her properly. The suit says this has led to physical pain, mental anguish and medical expenses.

Smith seeks damages, monetary relief of more than $1 million, all legal fees and interest, and all other relief the court deems just. She is represented by attorneys Christopher G. King and Hartley Hampton of Hampton & King in Houston.
