Hispanic female accuses dentist of discrimination

HOUSTON — A Houston woman is suing a local dental practice, alleging discrimination, a hostile work environment and violation of workers compensation acts.

Maria Banda, originally from Mexico but a Houston resident since 1985, filed a lawsuit Nov. 25 in the Houston Division of the Southern District of Texas against Dr. Mark A. Urbach, doing business as Urbach Pediatric Dentistry, alleging violation of the Fair Labor Standards Act and Title VII of the 1964 U.S. Civil Rights Act.

According to the complaint, Banda worked in excess of 40 hours per week and did not receive overtime pay at a rate of not less than one and one-half times her regular rate as required by FLSA. The plaintiff alleges the defendant did not make a good faith effort to comply with the overtime provisions of FLSA and intentionally discriminated against her because of her race and national origin.

Banda seeks trial by jury, compensatory, liquidated and exemplary damages, pre- and post-judgment interest, attorney fees, costs of court and all such other just relief. She is represented by attorney Eddrea T. McKnight of The McKnight Law Group in Houston.
