Lawsuit alleges McKinney cop assaulted pool party attendee

SHERMAN – The City of McKinney is facing a lawsuit over an incident last year in which a police officer allegedly used excessive force on a young girl at a pool party.

Attorney Kim T. Cole of the law firm K. Cole Law, PLLC in Frisco initiated legal action on behalf of the child and her guardian on Dec. 19 in the Sherman Division of the Eastern District of Texas.

Court papers accuse McKinney police officer Eric David Casebolt of ordering the girl, identified by her initials D.B., and her friends to vacate the pool and then assaulting her.

Casebolt, a co-defendant in the case, purportedly approached D.B. with a baton in hand, grabbed her by the wrist, and dragged her to the ground. Per the original petition, he slammed the girl face-first toward the concrete sidewalk twice.

The suit further asserts that the officer laid on top of D.B., who is black, and continued to attack her, claiming he pointed his service weapon at two boys who came close. D.B. insists that she obeyed Casebolt’s commands and did not attempt to harm him.

“The entire time D.B. she could do nothing by cry out in pain and repeatedly beg for her ‘Momma’ as she endured the pain inflicted upon her by defendant Casebolt’s physical assault,” the complaint says.

“At the time, D.B. was only 15 years old and barely weighed over 100 pounds. She was wearing nothing but a bikini bathing suit.”

The event reportedly left the child with multiple physical injuries and in psychological distress.

A jury trial is requested.
