HOUSTON — A Harris County couple is suing FedEx and one of its drivers, alleging their negligence led to a crash that injured the plaintiffs.
John Thompson and Kimberly Thompson filed a lawsuit Dec. 2 in Harris County District Court against Howell Ray Warren and FedEx Freight Inc., alleging FedEx negligently hired and retained Warren.
According to the complaint, on Dec. 5, 2014, John Thompson was operating a motor vehicle owned by Kimberly Thompson, who was a passenger traveling southbound on Interstate Highway 45 near the International Airport exit in Houston. The suit says Warren, who was operating an 18-wheeler truck owned and insured by FedEx, lost control of the vehicle and struck the rear of the Thompsons' vehicle.
The lawsuit says the Thompsons suffered injuries that resulted in pain and suffering, medical expenses and mental anguish. The plaintiffs allege Warren failed to swerve or maneuver and/or stop the vehicle to avoid a collision, failed to yield right of way and failed to maintain careful lookout.
The Thompsons seek trial by jury, judgment in an amount within the jurisdictional limits of the court, costs of court, pre- and post-judgment interest and all other appropriate relief. They are represented by attorney Craig D. Cherry of Haley Olson in Waco.
