HOUSTON — A Kentucky woman is suing hip prostheses providers, alleging design and manufacturing defects.
Julia Behrend of Olive Hill, Kentucky, filed a complaint Dec. 2 in Harris County District Court against Maxx Health Inc., Maxx Orthopedics Inc., Mipro US Inc., Encore Medical LP, et al, alleging violation of the Texas Deceptive Trade Practices Act.
According to the complaint, in 2007, Behrend was underwent a hip implant surgery into both her hips. Since then, the suit says, she continued to experience pain in her hips.
On Feb. 2, 2015, the lawsuit says, she was diagnosed with probable metallosis as the cause of pain and this required revision surgery. Following the revision implant surgeries, the suit states, Behrend has continue to suffer disfigurement, physical and mental pain, lost earnings and medical expenses.
The plaintiff alleges the defendants defectively designed, manufactured and marketed the hip implant, and failed to provide adequate information and warnings on using it.
Behrend seeks trial by jury, monetary relief of more than $1 million, pre- and post-judgment interest, cost of court and all other just and proper relief. She is represented by attorney Monica C. Vaughn of Houssiere, Durant & Houssiere LLP in Houston.
