Bank alleges borrower, guarantor broke agreement

HOUSTON — A bank is suing a borrower and guarantor, alleging beach of loan and of a security agreement.

BMO Harris Bank NA filed a lawsuit Dec. 1 in the Houston Division of the Southern District of Texas against Cloud 9 Trucking Ltd. and Veerpal Singh, alleging failure to to perform contractual obligations.

According to the complaint, as a result of defendants' breach, the principal amount of not less than $294,674.93 remains due. The plaintiff alleges the defendants have failed and refused to pay the amount due and owing under the agreements.

BMO Harris Bank seeks trial by jury, judgment against defendants in the amount due under the agreements and the guaranty, plus attorney fees, court costs and interest, plus all equitable relief. It is represented by attorney Michael H. Bernick of Reed Smith LLP in Houston.
