HOUSTON — A disabled veteran is suing Harris County law enforcement officers, alleging unlawful use of excessive force and illegal arrest.
Gilbert Cruz filed a complaint Dec. 5 in the Houston Division of the Southern District of Texas against Rolando Delgado Jr., G. Perkins, T. Cummings, K. Benoit, Sgt. M. Stouffer, Sheriff Ed Gonzales and Harris County, alleging violation of the First, Fourth and Ninth Amendments of the U.S. Constitution.
According to the complaint, as a result of defendants' unlawful actions following a domestic dispute, which included false arrest, excessive use of force and wrongful imprisonment, Cruz has suffered injuries to his person and liberty, as well as emotional distress, mental anguish and loss of employment. The suit says his car was repossessed.
The plaintiff alleges the defendants assaulted, arrested and detained Cruz for more than two months without legal basis.
Cruz seeks trial by jury, compensatory and punitive damages, pre and post-judgment interest, attorney fees, legal costs and expenses and all other proper relief. He is represented by attorney Jerold D. Friedman of Law Office of Jerold D. Friedman in Cypress.
