Customer accuses GM of breaching contract

HOUSTON — A customer is suing General Motors, alleging breach of implied and express warranties.

Sherry Ingraham of Houston filed a lawsuit Dec. 7 in Harris County District Court against General Motors LLC,  alleging violation of the Magnuson-Moss Warranty Act.

According to the complaint, on June 29, 2015, Ingraham purchased a 2015 GMC Yukon for $72,800. Since the purchase, the suit says, the vehicle has been defective in materials and workmanship, and the defects have substantially impaired the Yukon's use, value and safety. 

The plaintiff alleges General Motors refused to buy back the defective vehicle and failed to perform the repair work in a good and workmanlike manner.

Ingraham seeks trial by jury, monetary relief up to $100,000, actual damages, attorney fees, court costs and expenses and all other proper relief. She is represented by attorney G. Brad Riffle of The Riffle Law Firm PLLC in Frisco.
