Consumer alleges debt collector violated law

SHERMAN — A consumer is suing a Collin County debt collector, alleging deceptive collection practices.

Jamie Manning filed a complaint Dec. 12 in the Sherman Division of the Eastern District of Texas against Elevate Recoveries LLC, alleging violation of the Fair Debt Collection Practices Act.

According to the complaint, on June 2, 2016, Manning began receiving phone calls from Elevate's representative attempting to collect an alleged debt. As a result of the defendant's actions, the suit says, Manning she has suffered economic and emotional damages. 

The plaintiff alleges the defendant misrepresented the character, amount and/or legal status of Manning's debt and threatened that her alleged debt would be reported to the credit bureaus every week until the debt was paid.

Manning seeks trial by jury, judgment for actual and statutory damages, court costs, interest, and attorney fees. She is represented by attorneys Nathan J. Schwartz and Andy Nguyen of Law Office of Andy Nguyen PLLC in Arlington.
