GALVESTON — A Galveston County woman is suing an insurance company, alleging breach of an insurance contract.
Mary Lou Kirkland filed a lawsuit Dec. 13 in Galveston County District Court against Nationwide Lloyds Insurance Company, alleging breach of good faith and fair dealing.
According to the complaint, on Aug. 30, 2015, Kirkland began to notice foundation damage to her property at 409 Christina Lane, Friendswood. This foundation damage directly resulted from a previous plumbing leak that Nationwide had accepted responsibility to repair, the suit says.
As a result of defendant's wrongful denial, the lawsuit states, Kirkland has not been able to make necessary repairs to restore her home. The plaintiff alleges Nationwide Lloyds Insurance failed to attempt in good faith to effectuate a prompt, fair and equitable settlement and refused to pay the claim without conducting a reasonable investigation.
Kirkland seeks trial by jury, monetary relief of up to $100,000, together with penalties, costs, expenses, pre-judgment interest, attorney fees and all other proper relief. She is represented by attorneys Sean H. McCarthy and Loren Jackson of Williams Kherkher Hart Boundas LLP in Houston.
