Harris County traders allege manufacturer, investigator, tipster owe millions

HOUSTON — Two Harris County traders are suing a manufacturer, investigators and tipster, alleging false allegations and defamation.

Qaisar Dar and Charu Prasana filed a lawsuit Dec. 14 in Harris County District Court against American Outfitters Inc., Vaudra Ltd., Investigation Service Company LLC of Fort Worth and Mike Mitha of Houston, alleging that they wrongfully accused plaintiffs of trademark counterfeiting.

According to the complaint, Dar and Prasana suffered monetary damages for being unable to retrieve their seized property worth more than $700,000 of American Eagle Outfitters products and were forced to post bail to avoid incarceration.

The plaintiffs allege the defendants wrongfully accused them of selling counterfeit American Eagle apparel and wrongfully filed criminal charges against them for trademark counterfeiting.

Dar and Prasana seek trial by jury, monetary damages up to $15 million, together with interest, attorney fees, court costs and all other just and proper relief. They are represented by attorneys Lloyd E. Kelley of Houston, and by Terry Yates of Bellaire.
