BNSF Railway Co. employee alleges negligence caused injury to hand

GALVESTON – An Oklahoma man alleges three fingers were amputated while he was placing plates on new tires while working.

Stewart Newman filed a complaint on Dec. 14 in the Galveston Division of the Southern District of Texas against BNSF Railway Co. alleging negligence.

According to the complaint, the plaintiff alleges that on May 11, 2016, while working within the course and scope of his employment as a relief truck driver, three of the fingers on his left hand were amputated when a rail come down on his hand. He alleges he has undergone and needs to undergo medical treatment and will continue to suffer physical and mental pain. The plaintiff holds BNSF Railway Co. responsible because the defendant allegedly failed to provide safe and proper tools and equipment to perform his work.

The plaintiff requests a trial by jury and seeks judgment against defendant for all damages, pre- and post-judgment interest, costs of this action and such other just and proper relief. He is represented by Robert M. Tramuto of Jones Granger in Houston.
