Individuals allege Chesapeake, others did not pay royalties or underpaid them

HOUSTON – Mineral and royalty interest holders allege they have not been properly paid royalties on leased minerals in LaSalle County.

Malcolm Sumbera and Mary Sumbera filed a complaint on Dec. 15 in the Harris County District Court against the Chesapeake Operating LLC, OOGC America LLC, Jamestown Resources LLC, Pelican Energy LLC, et al. alleging breach of contract and fraud.

According to the complaint, the plaintiffs allege that as a direct violation of the lease, plaintiff suffered damages from not receiving the proper amount of royalties. The plaintiffs holds Chesapeake Operating LLC, OOGC America LLC, Jamestown Resources LLC, Pelican Energy LLC, et al. responsible because the defendants allegedly underpaid and/or failed to pay the full royalties on the leased mineral and deducted forbidden post-production costs from royalty payments.

The plaintiffs request a trial by jury and seek monetary relief of more than $200,000 but not more than $1 million, plus interest, attorney's fees and costs of court and such other just and equitable relief. They are represented by Richard T. Howell Jr. of Buckley, White, Castaneda & Howell LLP in Houston.
