Driver alleges furniture business failed to pay overtime

HOUSTON — A driver is suing a Houston furniture business, alleging violation of workers compensation acts in failing to pay proper overtime.

Manolo Tayum filed a class action complaint, individually and on behalf of all others similarly situated Dec. 27, in the Houston Division of the Southern District of Texas against Clay Road Furniture LLC and Furniture 4 Everyone LLC, alleging violation of the Fair Labor Standards Act.

According to the complaint, Tayum regularly worked between nine and 10 hours a day as a driver and laborer without receiving overtime compensation. The plaintiff alleges the defendants mis-classified him as independent contractor and paid him straight time, instead of time and a half for overtime hours he worked above 40 as required by FLSA.

Tayum seeks trial by jury, allowing this case to proceed as a collective action, all unpaid overtime compensation, liquidated damages, attorney fees and costs, post-judgment interest and all other proper relief. He is represented by attorney Taft L. Foley II of The Foley Law Firm in Houston.
