2 employees accuse orthopedic group of not paying overtime

HOUSTON — Two hourly paid employees are suing an orthopedic group, alleging violation of workers compensation acts in failing to pay overtime.

Elizabeth Calles and Mersha Ramic, individually and on behalf of all others similarly situated, filed a class action complaint Dec. 28 in the Houston Division of the Southern District of Texas against Orthopaedic Associates LLP and Dr. Alan J. Rechter, alleging violation of the Fair Labor Standards Act.

According to the complaint, Calles and Ramic routinely worked more than 40 hours per week without receiving proper overtime compensation. The plaintiffs allege the defendants failed to pay them for all hours they worked in excess of 40 hours per week at a rate of one and one-half times their regular rate of pay as required by FLSA and failed to maintain accurate pay records.

Calles and Ramic seek trial by jury, unpaid overtime wages, liquidated damages, litigation costs, pre- and post-judgment interest and all other necessary relief. They are represented by attorney Douglas B. Welmaker of Dunham & Jones PC in Austin.
