HOUSTON — A Harris County resident who put up capital for two construction businesses is now suing his business partner, citing alleged breach of a settlement agreement.
H. David Ramm, Waterside Construction LLC and WSD Construction LLC filed a complaint on Jan. 4, in the Harris County District Court against Gus H. (Trey) Comisky III, alleging that the partner failed to fulfill his obligations under the terms of a previous settlement agreement.
According to the complaint, the plaintiffs allege that as a result of defendant's actions, Ramm was not able to complete the winding up of the businesses. The plaintiffs hold Comisky responsible because the defendant allegedly refused to cooperate in the process of selling off the companies' assets and failed to provide all company correspondence and financial books and records.
The plaintiffs request a trial by jury and seek award of specific performance, award for actual and consequential damages, attorney's fees and other relief. They are represented by Andrew Caplan and Tanya Garrison of Weycer, Kaplan, Pulaski & Zuber PC in Houston.
