Former employee accuses used car dealer of wrongful discharge

HOUSTON — A Brownsville man is suing a used car dealer, alleging retaliation and wrongful or constructive termination.

Indalecio Perez filed a complaint Jan. 9 in Harris County District Court against Tricolor Auto Group LLC and David Gutierrez, alleging they retaliated against him by constructively terminating his employment.

According to the complaint, in April 2016, due to his refusal to perform illegal acts, Perez was wrongfully subjected to demotion, a reduction in salary and job responsibilities and reassignment to menial degrading work, Subsequently, the suit says, he was constructively discharged, which caused him to suffer past and future lost earnings and mental anguish. 

The plaintiff alleges the defendants demanded Perez falsify motor vehicles' state inspection reports and misrepresent to costumers that certain vehicles were mechanically sound and safe.

Perez seeks trial by jury, monetary relief of more than $1 million and all other equitable relief. He is represented by attorney Sidney Troy Nunez of Law Offices of Richard J.W. Nunez LLPC in Brownsville.
