Customer blames Walmart for fall

MARSHALL — A Tyler woman is suing Walmart, alleging negligence in failing to prevent injuries.

Kathleen Griffith filed a complaint Jan. 9 in the Marshall Division of the Eastern District of Texas against Wal-Mart Stores Inc., doing business as Walmart, alleging failure to exercise reasonable care to provide a safe environment.

According to the complaint, on Sept. 24, 2016, Griffith was entering Wal-Mart Neighborhood Market in Tyler when she encountered a drop in the elevation of the walking surface. The suit says this caused her to fall and sustain a traumatic injury that resulted in physical and mental pain and medical expenses. 

The plaintiff alleges Walmart failed to take corrective actions to eliminate the dangerous condition and failed to warn of the dangerous condition.

Griffith seeks trial by jury, compensation for the injuries and damages of more than $100,000, pre-judgment interest, costs of court and all other equitable relief. She is represented by attorney J. Chad Parker of Tyler.
