Bedias man claims Walmart failed to keep premises safe

GALVESTON — A Bedias man is suing Walmart Stores Texas, LLC, citing alleged insufficient measures were taken to prevent injuries.

Mark Chambers filed a complaint on Jan. 17 in the Galveston Division of the Southern District of Texas against Walmart Stores Texas alleging that the Madisonville store failed to keep its premises safe to customers.

According to the complaint, Chambers alleges that on March 9, his feet got caught in a cone on the floor laying on its side in front of the sliding-glass doors. He tripped over it and fell, hitting the side of a large box and collapsed. As a result, he suffered physical pain and was diagnosed with lumbar sprain that needed months of therapy. Chambers holds Walmart Stores Texas responsible because it allegedly failed to maintain a reasonably safe premises, failed to properly train its employees to keep premises free of hazards and recklessly disregarded his safety.

Chambers requests a trial by jury and seeks a sum in excess of the minimum jurisdictional limits of this court, actual damages, pre-judgement/post-judgement interest and any further relief to which he may show himself justly entitled.
