HOUSTON — A material supplier is suing Ricardo Fernando Supiciche and Martha Paola Martinez of Houston, citing alleged failure to deliver purchased products.
Morrell Masonry Supply Inc. filed a complaint on Jan. 11 in the Harris County District Court against the defendants alleging that they unlawfully misappropriated material funds.
According to the complaint, Morrell Masonry Supply alleges that it supplied masonry materials to the defendants' subcontractor, Carlos Gallegos, to complete a portion of the improvements at the defendants' property. The defendants currently owe the principal balance of $1,028.56. The plaintiff holds Supiciche and Martinez responsible because they allegedly conspired with others to defraud the plaintiff of the balance due for materials supplied.
Morrell Masonry Supply requests a trial by jury and seeks monetary relief of $100,000, judgment decreeing that plaintiff has a lien on the defendants' property, that plaintiff be granted an order to recover its debt, damages and costs and all other relief to which plaintiff is justly entitled.
