Recovery agents allege former employers failed to pay proper wages

MARSHALL — Two recovery agents are suing their former employers, alleging violation of applicable minimum wage law.

Nathaniel Higar and Shaelyn Bobbitt filed a class action complaint, individually and on behalf of all others similarly situated, Jan. 19 in the Marshall Division of the Eastern District of Texas against Task Force of Texas LLC and Albert Anderson, alleging violation of the Fair Labor Standards Act.

According to the complaint, during the course of their employment as recovery agents with the defendants, Higar and Bobbitt performed work in excess of 40 hours per week without being paid proper overtime compensation. Instead, the suit says, they were paid at sub-minimum wage rates for their work. 

The plaintiffs allege the defendants failed to compensate them at FLSA rates for overtime hours worked and failed to ensure that they were paid at least the lawful minimum wage.

Higar and Bobbitt seek trial by jury, compensation for all unpaid wages, liquidated damages, attorney fees and court costs, pre- and post-judgment interest and all other appropriate relief.
