Equipment operator alleges well completion company failed to pay overtime

TYLER — A Gregg County man is suing a private well completion company, alleging violation of workers compensation acts by not paying proper overtime.

Eric Thompson, individually and on behalf of all others similarly situated, filed a class action complaint Jan. 20 in the Tyler Division of the Eastern District of Texas against FTS International Services LLC, alleging violation of the Fair Labor Standards Act.

According to the complaint, beginning in December 2015 through the present, Thompson regularly worked as an equipment operator in excess of 40 hours per week, sometime working 80-90 hours per week, without receiving overtime compensation. 

The plaintiff alleges the defendant refused to compensate him for his employment in excess of 40 hours per week at a rate not less than one and one-half times his regular rate, as required by FLSA, and failed to maintain accurate time and pay records.

Thompson seeks trial by jury, an order allowing this case to proceed as a collective action, all unpaid overtime compensation, liquidated damages, attorney fees and costs and all other just and proper relief. He is represented by attorneys Melissa Moore and Curt Hesse of Moore & Associates in Houston.
