Two motorists blame vehicle owner, driver for crash

GALVESTON — Two Beaumont motorists are suing a vehicle owner and driver, alleging their negligence caused a crash that injured the plaintiffs. 

Jenny Day and Guillermo Moreno filed a complaint Jan. 20 in Galveston County District Court against Classic Auto Group-Galveston and Arthur Maxwell Jr., alleging Classic negligently entrusted the vehicle to Maxwell, an unlicensed and reckless driver.

According to the complaint,on Aug. 25, 2015, Day and Moreno were traveling on Interstate Highway 45 North when Maxwell, driving a loaner car from Classic Auto Group, violently struck the plaintiffs' vehicle from behind. 

The suit says the plaintiffs suffered severe injuries, resulting in physical and mental pain, loss of earnings and necessary medical care and expenses. The plaintiffs allege Maxwell breached his duty to exercise the degree of care that a reasonably careful person would use to avoid harm to others.

Day and Moreno seek trial by jury, monetary relief of more than $1 million and all other equitable relief. They are represented by attorney Brett S. Thomas of Roebuck & Thomas PLLC in Beaumont.
