Surgery center accuses attorney of fraud

HOUSTON — A surgery center is suing an attorney, alleging fraud and breach of fiduciary duty.

Fort Bend Surgery Center Inc., et al filed a complaint Jan. 23 in Galveston County District Court against Alex Nduka Udorah, alleging the attorney failed to comply with the provisions of the interest on lawyer trust accounts.

According to the complaint, Fort Bend Surgery Center rendered health care services to Udorah's client in order to validate and settle his client's personal injury claims.The suit says Udorah promised to pay his client's health care bills upon receipt of the settlement proceeds. 

The surgery center says it has not received payments for health care services provided. The plaintiffs allege Udorah has not made payments for health care bills incurred and misapplied IOLTA trust  proceeds.

Fort Bend Surgery Center seeks trial by jury, compensatory and punitive damages, pre- and post-judgment interest, costs of court and all other equitable relief. It is represented by attorney Phillip Brantley of Phillip Brantley & Associates PC in Houston.
