Tenant blames apartment complex operators for injuries

HOUSTON — A Harris County man is suing Houston apartment complex operators, alleging their negligence led to the plaintiff being assaulted. 

Porfirio Hinestroza-Viveros filed a complaint Jan. 23 in Harris County District Court against Woodscape Investment Ltd., doing business as Woodscape Apartments and Does 1-5, alleging they breached their duty to provide a safe premises.

According to the complaint, on Jan. 24. 2015, Hinestroza-Viveros was entering his apartment at 9707 Gessner Drive, Houston, when he was robbed and brutally assaulted by two assailants. As a result of the incident, the suit says, the plaintiff sustained severe personal injuries. 

The plaintiff alleges the defendants failed to ensure the safety of their tenants and/or invitees and failed to investigate and/or monitor criminal activities on the area surrounding of the property.

Hinestroza-Viveros seeks trial by jury, monetary relief of $200,000 and $1 million, plus all other just and equitable relief. He is represented by attorneys Cynthia Frederick and Ronald Fitzgerald of The Frederick Law Firm PLLC in Houston.
